Terms & Conditions

These Terms & Conditions ("Terms") govern any project, quote, or service provided by LMTR Performance, LLC ("LMTR Performance," "we," "us," or "our") to you ("Client," "you"). By requesting a quote, submitting a deposit, or engaging LMTR Performance for services, you agree to these Terms.

Services

LMTR Performance provides custom wiring harnesses, ECU & PDM integration, ECU calibration (MoTeC exclusively), CAN bus & data systems, and related special projects for motorsports, off-road, and competition vehicles, as described on this website. The specific scope of work for any project is defined individually following project discussion.

Intended use: Our products and services are intended for motorsports, racing, off-road, and competition applications. These systems are not intended for emissions-controlled street use unless specifically stated in writing for a given project.

Project Process

  1. Discussion. Every project begins with a discussion of the vehicle, intended use, components, timeline, and requirements.
  2. Quote & Plan. Once scope is defined, LMTR Performance provides a quote and project plan.
  3. Deposit. Most custom projects require a deposit before design, planning, or material ordering begins. Deposit amounts and terms are specified in the individual project quote.
  4. Build. Work proceeds according to the agreed scope, with attention to reliability, serviceability, and documentation.

Payment

Payment terms, including deposit amounts, milestone payments, and final balance due, are specified in each individual project quote. Work will not begin, and materials will not be ordered, until any required deposit has been received. Final products or vehicles may be held until payment in full has been received, where permitted by law.

Scope Changes

Any changes to the agreed project scope, including added components, revised requirements, or expanded work, may result in additional charges and adjusted timelines. Scope changes should be discussed and agreed upon before work proceeds.

Timelines

Project timelines are estimates based on the information available at the time of quoting. Timelines may be affected by parts availability, scope changes, vehicle condition, or other factors outside our control. We will communicate any significant timeline changes as they arise.

Client Responsibilities

The Client is responsible for providing accurate vehicle, component, and project information. The Client is responsible for ensuring the vehicle is used in accordance with its intended motorsport, off-road, or competition application, and in compliance with applicable rules, regulations, and venue requirements.

Limitation of Liability

To the fullest extent permitted by law, LMTR Performance's liability for any claim arising from our services is limited to the amount paid by the Client for the specific service giving rise to the claim. LMTR Performance is not liable for indirect, incidental, or consequential damages, including loss of use, loss of competition time, or third-party claims, except where such limitation is prohibited by law.

Warranty

Warranty terms applicable to our services are described in our Warranty / Refund Policy, which is incorporated into these Terms by reference.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued engagement of our services after changes are posted constitutes acceptance of the updated Terms.
